1. About these terms
These terms govern your use of the website at eywasolutions.net (the "Site") operated by [CLIENT-TO-PROVIDE: Registered legal name] ("Eywa Solutions", "we", "us"), a company registered in Malta under company number [CLIENT-TO-PROVIDE: Malta Business Registry (MBR) company number].
By using the Site, you agree to these terms. If you do not agree, do not use the Site.
2. The services described on this Site
The Site describes three practices: VR Tours & Spatial Capture, AI Concierge & Agents, and Custom IT & Automation. Descriptions of these practices, pricing tiers, hosting rates, add-ons, and any other commercial information published on the Site are indicative and do not constitute a binding offer.
Any actual engagement is governed by a separate, written contract signed between Eywa Solutions and the client following a discovery call and written scoping document. The terms of that contract — not the Site copy — define the legal relationship.
3. Your responsibilities when using the Site
When you use the Site, you agree not to:
- Attempt to gain unauthorised access to any part of the Site, its server, or related infrastructure.
- Use any automated system (scrapers, bots) in a way that imposes an unreasonable load on the Site beyond what a typical user would generate. Well-behaved AI crawlers acting on behalf of a human user are welcomed (see /llms.txt).
- Use the Site or its content to harass, defame, or harm any individual or organisation.
- Reproduce, distribute, or modify Site copy or visual assets for commercial purposes without written permission, except as permitted by applicable copyright limitations (e.g. fair quoting in journalism, research).
4. Intellectual property
Site copy, design tokens, and visual assets (including the brand mark) are owned by Eywa Solutions and protected by copyright and applicable trademark law. The site source is not open-source; permission for reuse is granted on request, in writing.
Deliverables created during a client engagement (code, designs, captured tours) are licensed to the client under the terms of the engagement contract. The Site's terms do not govern engagement deliverables.
5. Pricing on the Site
All prices on the Site are in euros (EUR), exclude VAT, and are subject to confirmation in writing during scoping. Tier pricing ("from €X") is anchored on the standard scope for each tier; project-specific scope, complexity, or location may adjust the final price. The Site does not bind us to deliver at the price shown if the actual scope exceeds the tier scope.
6. Warranties and disclaimers
The Site is provided "as is" and "as available". To the maximum extent permitted by Maltese law, we make no warranty that:
- The Site will be uninterrupted, error-free, or available at all times.
- Information published on the Site (including pricing, timelines, integration availability) is accurate at every moment in time — we update the Site as the offer evolves, but a discovery call is always the binding source of truth.
- The Site is free from viruses or other harmful components.
Statements describing the services we build for clients (the AI Concierge, VR tours, custom integrations) describe what we deliver under a signed engagement contract — they are not warranties extended to Site visitors.
7. Limitation of liability
To the maximum extent permitted by Maltese law, Eywa Solutions is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including but not limited to loss of profits, loss of data, or business interruption — even if we have been advised of the possibility of such damages.
Nothing in these terms limits or excludes liability that cannot be limited or excluded under Maltese law (including, for example, liability for fraud or for death or personal injury caused by negligence).
8. Third-party services and links
The Site links to external services (cal.com for booking, idpc.org.mt for the data-protection authority, github / google fonts for runtime assets). We are not responsible for the content or terms of those external services. Once you leave the Site, the external provider's terms apply.
9. Changes to the Site and these terms
We may change the Site, the services described on it, or these terms at any time. Material changes to these terms will be reflected by an updated date below; continued use of the Site after changes constitutes acceptance of the new terms.
10. Governing law and jurisdiction
These terms and any dispute arising from your use of the Site are governed by the laws of Malta. The courts of Malta have exclusive jurisdiction to hear any such dispute, unless mandatory consumer-protection law in your country of residence grants you the right to bring proceedings in your local courts.
